Most properties protected by the Kennebec Land Trust are not suitable or open for use by motorized vehicles such as ATV’s, four-wheelers, dirt bikes, four wheel drive vehicles or other motor driven machines designed or intended to be used in off-road situations, except for snowmobiles operated in winter conditions on designated trails.
KLT Board policy prohibits the use of ATV’s on its properties, except on certain specific properties where there is established use that can be accommodated on suitable trails. This policy applies to the section of trail located on the Nancy’s Bog parcel in Winthrop. This segment of trail extends from a connection to the Soper Road, utilizes a section of the Bog Road, then follows the logging road and ends at the KLT property boundary on the northwest side of the bog. No ATV use is authorized on or across the bog itself.
State law provides that “A person may not operate an ATV on the land of another without the permission of the landowner or lessee. Permission is presumed on ATV trails that are conspicuously posted or in areas open to ATV’s by landowner policy.” It adds that landowner permission may be either verbal or written, depending on the landowner’s policy.
